Tobacco giant R.J Reynolds has thrown e-cigarette manufacturers under the bus by filing legal complaints that could have serious consequences for the vaping industry.
The company behind the vaping brand Vuse filed complaints with the USITC on 26 February 2026, triggering an official investigation.
What Are The Accusations?
R.J Reynolds is accusing a group of Chinese e-cigarette manufacturers and their U.S distributors of importing vaping products in ways that break both federal and state laws.ย
16 companies have been named, including manufacturers across China, and distributors spread across multiple U.S states.
R.J. Reynolds claims these companies have been:
- Selling flavored products in states with active flavor bans
- Dodging state tobacco directory registration requirements
- Underpaying taxes
- Violating the PACT Act, which governs how nicotine products can be sold and shipped in the U.S.
If the investigation backs up those claims, R.J. Reynolds wants either a blanket import ban on the products in question or targeted orders against the 16 named companies.

If R.J. Reynolds gets what it’s after, a huge portion of the disposable vape market could be wiped out almost overnight. A lot of the brands you see in vape shops and convenience stores come from exactly the kind of manufacturers and supply chains this complaint is targeting. If you have a vape near you, check where it was made. Youโre most likely to see cities in China, like Guangdong or Shenzhen, credited as the makers of your device.
So, if R.J. wins, that means fewer products on the shelves, and the ones that remain will experience a surge in price. Itโll also leave many independent retailers with empty shelves and no obvious replacement stock.ย

Why is R.J. Reynolds Doing This?
Well, they’re certainly not doing this out of concerns for public health. They’re one of the biggest players in the vaping space, and by removing their competitors, they can help themselves to a larger share of the market.
It doesn’t take a genius to see who benefits most from a ruling like this, and it’s certainly not the independent side of the industry.
What Happens Next?
Nothing has been decided yet, and the USITC has made it clear that launching the investigation doesn’t mean anyone has been found guilty. They still need to go through official hearing procedures first, and a date hasnโt been set as of the time of writing.
But, in the worst-case scenario, if an import ban is issued, it takes effect immediately unless the U.S Trade Representative overrules it within 60 days.
This one is certainly worth watching and could completely reshape the disposable vaping industry in the U.S forever.
